1. Who We Are
BibliXP is a Bible learning mobile app and related website operated by BIBLIXP, INC., a Delaware corporation with operations in the State of Florida ("BibliXP," "we," "us," or "our"). You can reach us at [contact@biblixp.com] or by mail at [BIBLIXP MAILING ADDRESS].
These Terms and Conditions (the "Terms") apply to the BibliXP mobile app on iOS and Android, the BibliXP website, and any related services, features, content, or communications that link to these Terms (collectively, the "Service").
2. Acceptance of These Terms
By creating an account, signing in, continuing as an anonymous guest, starting a free trial, making a purchase, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as updating this page, sending an in-app notice, or emailing the address on your account. Continued use of the Service after the changes take effect means you accept the updated Terms.
3. Eligibility
BibliXP is intended for users who are 16 years of age or older. You may not use the Service if you are under 16. By using the Service you represent that you are at least 16 years old and that you have the legal capacity to enter into these Terms.
If you use the Service on behalf of an organization, church, school, ministry, family, or other group, you represent that you have authority to accept these Terms for that entity and for the individuals using the Service through it.
4. Accounts and Sign-In
You can use BibliXP with an anonymous guest session, an email and password account, or by signing in with Apple or Google. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
If you start as an anonymous guest, your local progress can later be linked to an account you create. Once you sign in or sign up, your prior anonymous session may be merged into the new account or replaced, depending on the flow you complete.
You agree to provide accurate information, to keep it current, and not to impersonate another person, share an account, create accounts to abuse the Service, or attempt to access another user's account.
5. Subscriptions, Free Trial, and Billing
BibliXP offers a free tier and a paid "Premium" subscription with monthly and yearly billing options. New users may be eligible for a 7-day free trial of Premium.
Subscriptions are processed through the Apple App Store or Google Play and are charged to the payment method on file with that store. Your subscription will renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period through your Apple ID or Google account settings.
If you start a free trial, your selected subscription will begin and your payment method will be charged at the end of the trial unless you cancel before the trial ends. The trial is available once per user and is subject to Apple and Google eligibility rules.
Refund, billing dispute, payment-method, and family-sharing requests for App Store and Google Play purchases are handled by Apple and Google under their terms. Except where required by law, fees are non-refundable, and canceling a subscription does not generate a prorated refund for the current billing period. Pricing, features, trial length, and offerings may change for future periods, and we will display the current terms before you confirm a purchase.
Deleting the BibliXP app does not automatically cancel your subscription. To cancel, manage your subscription in the App Store or Google Play account that made the purchase.
6. Community, Multiplayer, and User Content
BibliXP includes social features such as public profiles, usernames and avatars, an activity feed, reactions, follows and follow requests, a "Shepherd / Sheep" mentorship system, multiplayer Bible sessions, invitations, leaderboards, and shareable activity links.
When you use these features, certain information you choose to share, such as your username, avatar, learning progress, achievements, season-pass title, streaks, reactions, and the activities you publish, may be visible to other users, to people you invite, or to anyone with a share link, depending on your account's activity-visibility setting and the feature in use.
You are responsible for the content and activity you submit, share, or transmit through the Service ("User Content"). You retain your rights in your User Content. You grant BibliXP a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use your User Content as needed to operate, provide, secure, and improve the Service, including for community features and shareable activity links.
You agree not to post, share, or transmit content that is unlawful, fraudulent, harassing, hateful, threatening, sexually explicit, exploitative of minors, defamatory, infringing, misleading, spammy, malicious, or otherwise harmful, and you agree not to use the Service to harm, deceive, harass, or violate the privacy of others.
We may, at our discretion and without obligation, review, remove, restrict, disable, or report User Content, accounts, or activity that we reasonably believe violates these Terms, harms users, harms the Service, or is required to be addressed by law.
7. Bible Learning Content
BibliXP provides Bible learning content, daily lessons, quizzes and other interactive tasks, daily quests, weekly and spotlight challenges, speed trials, multiplayer rounds, achievements, XP, gold, stamina, streaks, season passes, and similar gamified features. Bible content is presented for educational and devotional purposes.
BibliXP is not a substitute for professional pastoral care, counseling, mental-health treatment, medical advice, legal advice, financial advice, or emergency services. If you are in crisis or need urgent help, please contact a qualified professional or your local emergency services.
We work to keep content accurate and useful, but we do not warrant that every lesson, Scripture reference, translation note, score, reward, ranking, schedule, or generated progress state will be error-free, complete, or available without interruption.
8. Acceptable Use
You agree not to: (a) reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except to the extent applicable law expressly permits; (b) copy, scrape, mirror, resell, sublicense, or commercially exploit the Service or its content except as expressly permitted; (c) interfere with or disrupt the Service, its security, its integrity, its servers, or other users; (d) use bots, scripts, automation, or other means to inflate XP, streaks, leaderboards, rewards, season-pass progress, multiplayer outcomes, or any other game state, or to evade limits, stamina, or anti-abuse controls; (e) bypass authentication, rate-limiting, payment, entitlement, or moderation controls; or (f) use the Service in violation of any law or regulation that applies to you.
You are responsible for any device, network, mobile-data, or other charges you incur while using the Service.
9. Intellectual Property
BibliXP, including its name, brand, design, software, source code, lessons, task formats, artwork, illustrations, animations, sound effects, achievements, season-pass content, avatars, frames, titles, and other original content, is owned by BibliXP or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
Bible text, fonts, third-party libraries, platform services, images, and other third-party content used in the Service are provided under their own licenses, and the rights in that material remain with their respective owners.
Subject to your continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the BibliXP mobile app on devices you own or control, and to access the website, solely for your own personal, non-commercial use.
10. Third-Party Services and Stores
The Service relies on third party services, including Supabase (backend, authentication, database), Apple Sign in with Apple, Google Sign In, RevenueCat (subscription management), PostHog (product analytics and event measurement), the Apple App Store, Google Play, and Expo push notification services. Your use of features that depend on these services is also governed by their terms.
Apple and Google may impose additional terms on App Store and Google Play purchases. Apple is a third-party beneficiary of these Terms with respect to your use of the iOS app and may enforce them against you, and you acknowledge that Apple is not responsible for the Service or any claims relating to it.
11. Termination
You may stop using the Service at any time. You may also delete your account from within the BibliXP app, which will initiate deletion of your account and associated personal information as described in the Privacy Policy. Deleting your account does not automatically cancel a subscription billed by Apple or Google; you must cancel that separately through the applicable store.
We may suspend, restrict, or terminate your access to all or part of the Service, with or without notice, if we reasonably believe you have violated these Terms, are creating risk for the Service or its users, or are using the Service unlawfully, or if we are required to do so by law or by Apple or Google.
Sections of these Terms that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.
12. Disclaimers
Except where prohibited by law, the Service is provided on an "as is" and "as available" basis, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, BibliXP disclaims all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, free of viruses or other harmful components, or that defects will be corrected. You use the Service at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, BibliXP and its officers, directors, employees, contractors, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, BibliXP's total aggregate liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid BibliXP for the Service in the twelve (12) months preceding the event giving rise to the claim, and (b) one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. In that case, the limitations apply to the maximum extent permitted by applicable law.
14. Indemnification
You agree to defend, indemnify, and hold harmless BibliXP and its officers, directors, employees, contractors, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.
15. Governing Law, Arbitration, and Class-Action Waiver
These Terms and any dispute or claim arising out of or relating to them or to the Service will be governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and, where applicable, by the United States Federal Arbitration Act.
PLEASE READ THIS SECTION CAREFULLY. EXCEPT AS DESCRIBED BELOW, ALL DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND YOU AND BIBLIXP ARE EACH WAIVING THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Before starting an arbitration, you agree to first send a written notice of the dispute to BibliXP at the address above and give us at least sixty (60) days to attempt to resolve it informally.
If informal resolution fails, the dispute will be submitted to binding individual arbitration administered by JAMS under its then-current Streamlined or Comprehensive Arbitration Rules, with one arbitrator. Arbitration will be held in the State of Delaware, conducted in English, and judgment on the award may be entered in any court of competent jurisdiction. You may elect to participate in the arbitration by phone, video, or in person.
You may instead bring an individual action in small-claims court if your claim qualifies. Either party may seek injunctive or other equitable relief in court for actual or threatened infringement, misappropriation, or violation of intellectual property or unauthorized access.
You and BibliXP agree that arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, mass, or representative action. If a court decides this class-action waiver is unenforceable as to a particular claim, that claim must be brought in court and will be severed from any arbitration.
You may opt out of arbitration by sending a written opt-out notice to the address or email above within thirty (30) days of first accepting these Terms. Your notice must include your name, the email associated with your BibliXP account, and a clear statement that you opt out of arbitration. If you opt out, disputes will be resolved exclusively in the state or federal courts located in Delaware, and you and BibliXP consent to the personal jurisdiction of those courts.
Nothing in this section limits any non-waivable rights you have under applicable consumer-protection laws.
16. App-Store Specific Terms (Apple)
The following applies if you obtain the iOS app through the Apple App Store. These Terms are between you and BibliXP only, not with Apple, and Apple is not responsible for the app or its content. Your license to use the iOS app is limited to a non-transferable license to use the app on any Apple-branded product that you own or control as permitted by Apple's usage rules.
Apple has no obligation to provide maintenance and support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation.
BibliXP, not Apple, is responsible for addressing any claims you or any third party may have relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation. BibliXP, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property claim that the app or your use of it infringes that third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
17. Export and Sanctions
The Service is operated from the United States. You may not access or use the Service if you are located in, are a national or resident of, or are otherwise subject to comprehensive sanctions imposed by the United States, or are on any U.S. Government list of prohibited or restricted parties.
18. Miscellaneous
These Terms, together with the Privacy Policy and any other terms referenced in them, constitute the entire agreement between you and BibliXP concerning the Service and supersede any prior agreements on the same subject. Our failure to enforce a provision is not a waiver of our right to do so later. If any provision is held unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
